What is Mediation?
Mediation is a confidential process that allows a third party, the Mediator, to assist in dispute resolution. A Mediator is  neutral and impartial, does not advocate for either side, and does not offer legal or financial advice.

 

Mediation begins with the Mediator explaining their role and how the process works. They facilitate the conversation in order to assist the parties in reaching a decision. Each person involved has a chance to talk. Particiants are encouraged to share thoughts, feeling, wants, and needs. In court, parties only have a say through their attorneys.

 

If there is information that you do not wish to share with the other participants, the mediator will go into caucus (meet with each side individually). The information discussed in caucus will remain confidential, unless asked by the party for the mediator to share. 

 

If an agreement is reached, it is put in writing and signed by each party. This agreement is considered binding by the courts. If no agreement is reached, then taking the case before a judge is a valid option.
